Official Rules for Evidence Action Survey Sweepstakes

Eligibility: Evidence Action Survey Sweepstakes (the "Sweepstakes”) is open only to individuals who are at least eighteen (18) years old at the time of entry. Employees of Evidence Action (“Sponsor”), its affiliates and subsidiaries, or any person or entity involved in the planning, preparation, or execution of the Sweepstakes, as well as the immediate family and household members of such individuals, are not eligible to enter. If the Sweepstakes is prohibited by any local laws, you are prohibited from participating in the Sweepstakes, and the Sponsor, in its sole discretion, may take steps to limit or ban your participation.
Agreement to Official Rules: By entering the Sweepstakes, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions regarding the Sweepstakes, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry Period: The Entry Period begins on June 14, 2024 beginning at 12:00AM ET and ends on July 12, 2024 at 11:59PM ET (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
How to Enter: You must be a subscriber to Sponsor’s emails during the Entry Period to enter. Sponsor will send an email out to its email subscribers on June 14, 2024 with a link to complete a survey during the Entry Period. Upon completion of the survey, you will be entered into the Sweepstakes. There is a limit of one (1) entry per person. You may not use multiple email addresses, identities, or devices to enter, or any agency or automated or AI system. Sponsor reserves the right to disqualify any entries received through such methods, as determined in its sole discretion.
Entrant’s Warranties and Representations: By submitting an Entry, you represent and warrant that your entry complies with all requirements of these Official Rules.
Drawing and Prize(s): The Sponsor will conduct the random drawing on or about July 15, 2024 to select the potential winner. The odds of being selected depend on the number of eligible entries received during the Entry Period. Sponsor will attempt to notify the potential winner within 10 business days of the drawing. There will be one (1) prize awarded. The winner will receive a $200 gift card. The winner is responsible for paying any and all costs and expenses associated with the prize not otherwise listed herein. Any prize details not specified herein will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.
Requirements of Potential Winner(s): Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and/or a liability/publicity release within seven (7) days of being initially contacted by the Sponsor. If a potential winner fails to sign and return these documents within the required time period, the potential winner will be deemed to have forfeited his or her winnings and an alternate potential winner may be selected in their place in a random drawing of all remaining entries received.
General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention, any other technical problem, or any circumstances beyond Sponsor’s reasonable control, Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to seek remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of the winner based on an email address, the winning Entry will be declared by the authorized account holder of the email address submitted at time of entry. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited. Your Entry must not, as determined by Sponsor in its sole discretion: (i) violate the rights of others, including intellectual property rights; (ii) contain defamatory statements; (iii) include threats to any person, place, business, or group; (iv) include instructions or activities that could cause harm or injury (v) be obscene or indecent; (vi) depict any risky behavior; (vii) contain any material or content that is libelous or in any way unlawful; or (vii) contain depictions of any individuals who have not granted permission to appear in the Entry. Sponsor reserves the right in its sole discretion to supplement or make changes to these Official Rules without notice. Sponsor also reserves the right in its sole discretion to interpret the rules of this Sweepstakes in any manner, and such interpretation shall be binding on any entrant and Entry. These Official Rules and your participation in the Sweepstakes are subject to Sponsor’s Terms of Use and Privacy Statement. If there is any inconsistency between the terms of use, privacy statement and these terms, the terms of use and privacy statement will prevail.
Release and Limitations of Liability: By participating in the Sweepstakes, entrants agree to release and hold harmless, collectively and individually, the Sponsor and each of its subsidiaries, affiliates, officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto)Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, not to exceed $100.00, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Publicity: Any information you provide when you enter the Sweepstakes will be used in accordance with Sponsor’s Privacy Statement. Except where prohibited, participation in the Sweepstakes constitutes your consent to Sponsor’s use of your name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any and all media now known or hereafter devised, both commercial and non-commercial, all as Sponsor deems appropriate in its sole discretion, and without further payment or consideration. Entrant waives any right to inspect or approve Sponsor’s, or its affiliates’ or subsidiaries’, use of the Entry as herein permitted, and entrant releases Sponsor and its agents from any and all claims arising out of its use of the Entry as herein permitted, including but not limited to, invasion of privacy, rights of publicity, or unintentional errors occurring in such use and publication, excluding fraud and negligence.
Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Washington, DC. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of law rules (whether of Washington, DC or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Washington, DC.
Results: To request the names of the winner of any prize over $25.00, please send a self-addressed stamped envelope to Evidence Action, 1133 Connecticut Avenue, NW, Suite 200, Washington, DC 20036. Requests must be received by August 15, 2024.
